Luật Bảo hiểm xã hội (Sửa đổi): Cần khoa học và có tính khả thi

Với mục đích bảo đảm an sinh xã hội (ASXH) của người dân dựa trên quyền con người theo quy định của Hiến pháp và thể chế hóa các nội dung trong Nghị quyết số 28-NQ/TW theo hướng đa dạng, linh hoạt, đa tầng, hiện đại, hội nhập quốc tế và tiến tới bao phủ bảo hiểm xã hội (BHXH) toàn bộ lực lượng lao động, việc sửa đổi căn bản các vướng mắc và bất cập từ thực tiễn thi hành Luật BHXH năm 2014 và Nghị quyết số 93/2015/QH13; Bảo đảm tính hợp hiến, hợp pháp, tính đồng bộ, thống nhất, có tính khả thi, phù hợp tiêu chuẩn quốc tế và bảo đảm yếu tố bình đẳng giới là cần thiết. Sửa đổi Luật BHXH lần này theo hướng mở rộng, gia tăng quyền, lợi ích và tạo sự hấp dẫn để thu hút người lao động tham gia BHXH. Qua đó, bảo đảm tốt nhất quyền lợi cho người lao động đang làm việc và người hưởng lương hưu. Đồng thời, Luật sửa đổi cũng hoàn thiện quy định quản lý nhà nước và hệ thống tổ chức thực hiện chuyên nghiệp, hiện đại, hiệu quả, công khai, minh bạch phù hợp cơ chế quản lý và bối cảnh mới của nền kinh tế.

Abstract
With the purpose of ensuring social security of the people based on human rights according to the provisions of the Constitution and institutionalizing the contents of Resolution No. 28-NQ/TW in a diverse and flexible direction, multi-layered, modern, internationally integrated and moving towards social insurance coverage of the entire workforce, fundamentally amending the problems and shortcomings from the practice of implementing the 2014 Social Insurance Law and Resolution No. 93/2015/QH13. Ensuring constitutionality, legality, synchronization, unity, feasibility, international standards and gender equality is necessary. Amend the Social Insurance Law this time in the direction of expanding, increasing rights, benefits and creating attractiveness to attract workers to participate in social insurance. Thereby, ensuring the best benefits for current employees and pensioners. At the same time, the amended Law also perfects state management regulations and a professional, modern, effective, open and transparent implementation organization system in accordance with the management mechanism and the new context of the economy
